Litigation Update

09-12-09
Catherine Henry

Recently our health lawyers have successfully resolved two significant and tightly contested medical negligence matters. Both matters involved Hunter residents and local health facilities and doctors.

In Hope v Hunter New England Area Health Service we acted for the plaintiff client who successfully brought a claim following a permanent injury to his left hand during surgical removal of a ganglion. The judgement of Judge Levy of the NSW District Court dated 27 November is the most recent in a line of cases which have considered the meaning to be given to “widely accepted peer professional opinion.” Click here to read more about the case.

In Honnery v Hunter New England Area Health Service our client lost her leg and a kidney following complications arising from elective aneurism surgery. It was claimed that the complications that occurred were not consistent with competent professional practice. The hearing of the case was significantly fast-tracked owing to our client's very poor state of health. After six days of evidence, the parties reached agreement and we succeeded in resolving our client's matter. Read more about the case Article 1 and Article 2
